The Oh My Tales site (hereinafter referred to as the “Site”) is operated by Des Clics Nomades, (hereinafter referred to as “we”, “us” or “our”). Use of the Site is subject to the following general conditions of use (CGU) (hereinafter referred to as the “CGU”). By using the Site, you accept these T&Cs in their entirety.
1. Use of the Site
1.1 The website is intended to provide free stories for children and tools to create personalized stories. We reserve the right to modify, suspend or interrupt the Site at any time, without notice.
1.2 Use of the Site is free and no fees will be charged to access the content offered.
1.3 You must be at least 18 years old to use the Site. If you are a minor, you must obtain the consent of your parent or legal guardian before using the Site.
2. Intellectual property
2.1 The Site and its content (including, but not limited to, text, images, graphics, logos, icons, sounds, videos, software, databases, source codes and objects) are protected by French and international laws relating to intellectual property.
2.2 Unless expressly authorized by us, it is prohibited to reproduce, copy, sell, resell or exploit for commercial purposes all or part of the content of the Site.
3. Limitation of liability
3.1 We will not be liable for any damage or harm resulting from the use of the Site, including, but not limited to, loss of data, loss of profits, loss of business opportunities or any other financial loss.
3.2 We cannot be held responsible for any damage or harm resulting from the use of a hyperlink present on the Site.
4. Modification of the T&Cs
4.1 We reserve the right to modify the T&Cs at any time, without notice.
4.2 The T&Cs in force are those which are accessible on the Site at the time of your use.
5. Applicable law and competent jurisdiction
5.1 These T&Cs are governed by French law.
5.2 Any dispute relating to the use of the Site will be subject to the exclusive jurisdiction of the French courts.
6. Account creation and personal data management
6.1 To benefit from certain additional features of the Site, such as creating a collection of favorites, you have the option to create a user account. To do so, you must provide a name and a valid email address. You agree to provide accurate information and keep it up to date.
6.2 The data collected (name and email address) are used only for the management of your user account, access to personalized features such as the collection of favorites, and sending possible communications relating to your account or the services offered by the Site, subject to your prior consent.
6.3 Your personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the French laws in force. We are committed to taking all necessary technical and organizational measures to ensure the security of your personal information and prevent unauthorized access to it.
6.4 The data related to your account is retained for as long as you keep your account active. If you decide to delete your account, your personal data will be deleted within a reasonable time after receipt of your request, unless there are legal retention obligations.

6.6 You can delete your account and all associated data at any time via your account settings or by contacting our support. After deletion, all your data will be permanently deleted from our systems within a reasonable period of time, unless there is a legal obligation to retain it.
6.7 You are responsible for keeping your account information confidential, including your password. We accept no liability for any unauthorized access to your account due to your negligence. We recommend that you use a strong password and change it regularly to increase the security of your account.
7. Newsletter
7.1 We offer a newsletter that allows you to receive stories for free every week via email. By signing up for this list, you agree to receive emails from us.
7.2 Your email address will be used solely for sending communications related to the newsletter. We are committed to not using your email address for other purposes without your explicit consent, and to not sharing it with third parties without your prior agreement, except as required by law.
7.3 You can unsubscribe from the newsletter at any time by clicking on the unsubscribe link in each email, from your user account, or by contacting our support to assert your rights.
7.4 Your data will be retained as long as you are subscribed to the newsletter. In case of unsubscription, we will delete your data from our systems, except in cases of legal retention obligations.
8. Custom Story Creation Tool
8.1 We offer a tool to create personalized stories for children. To use and access this tool, you must create an account (see section 6 of the terms of use) and provide personal data such as your child's first name and age.
8.2 Your personal data, as well as that of your child, will be used exclusively for the purpose of personalizing the stories. We are committed to not using this data for other purposes without your prior consent.
8.3 No sensitive data (health information, religion, sexual orientation, etc.) is collected or processed in connection with this tool. We invite you to provide only the strictly necessary information for creating the stories.
8.4 We do not share your personal data or that of your child with third parties, unless required by law or to ensure the provision of the service (for example, with technical providers). In this case, we are committed to ensuring that these third parties adhere to the same standards of confidentiality and security.
8.5 You can delete information related to your child at any time by modifying your account settings or by deleting your account (see section 6). The data will be deleted within a reasonable time after deletion.
8.6 The use of the story creation tool relies on artificial intelligence algorithms. While we strive to ensure the relevance and quality of the generated stories, we cannot guarantee perfect or error-free personalization. We disclaim any responsibility regarding automatically generated content.
8.7 The stories and illustrations created using the tool can be freely distributed, adapted, modified, and shared by users, provided that you cite the source and link to our website www.ohmytales.com. This mention must appear visibly and identifiably in all uses of the stories and illustrations, whether in digital or printed form. Any failure to comply with this obligation could result in penalties, including the suspension of your account. Finally, commercial use of these stories is only permitted for stories created with a paid plan.
9. Paid Plans
9.1 The Site offers paid plans that allow access to advanced and exclusive features, intended for users wishing to benefit from more flexibility in personalizing stories and illustrations. The details of the specific conditions for purchasing these plans are available in our General Terms of Sale.9.2 Each plan is subscribed with automatic renewal on the due date (monthly or annually, depending on the choice of the plan). Before this due date, the user can cancel the automatic renewal by accessing their account settings.
9.3 Paid plans are subject to a 14-day withdrawal right following the first payment for the relevant plan, allowing for a full refund. After this 14-day period, no right of withdrawal can be exercised, due to the nature of the digital service provision.
